Terms of Service

Thank you for using PinSight (hereinafter referred to as "the App"). These Terms of Service (hereinafter referred to as "the Terms") set forth the rules for users to appropriately use the App provided by the operator (hereinafter referred to as "the Operator").

By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Service Overview

PinSight is a live information-sharing platform where users can request information about the status of specific locations (price, congestion, scenery, etc.), and other users respond with photos and information taken on-site.

2. Eligibility and Account

• Eligibility: You must be at least 13 years of age (or the minimum age required by law in your country of residence) to use the App.
• Authentication: The App utilizes anonymous authentication for convenience.
• Responsibility: Users are responsible for appropriately managing their own device and authentication information. The Operator may restrict use in the event of unauthorized access or use.

3. Safety Warnings and Prohibited Actions

As the App involves activities in the real world, users must comply with the following:

• Avoid Restricted Areas: Unauthorized entry or trespassing on private property, restricted areas, or dangerous locations for photography or information gathering is strictly prohibited.
• Public Safety: Comply with all traffic rules and always be aware of your surroundings. Operating the device while walking ("distracted walking") or while driving is strictly prohibited.
• Facility Rules: When shooting inside commercial or public facilities, follow the rules of each facility and obtain permission from the management as necessary.
• Portrait Rights: If individuals are included in photos, you must obtain their consent or ensure that they cannot be personally identified.
• Inappropriate Content: Posting content that is violent, obscene, harassing, defamatory, or contains false information is prohibited.

4. Point System

• Points within the App (hereinafter referred to as "pts") are incentives to facilitate requesting, responding, and viewing within the service and have no monetary value.
• pts cannot be exchanged for cash, refunded, or transferred outside of the App.
• The Operator may correct or confiscate pts in the event of system failures or violations of the Terms.

5. User-Generated Content (UGC) and Moderation

• Ownership of Rights: Copyright of the posted content belongs to the user. However, to the extent necessary for the operation of the App, the Operator shall be granted a free and perpetual license to use (reproduce, process, display, etc.) the content.
• Monitoring and Filtering of Objectionable Content: The Operator implements automatic filtering systems and regular checks to ensure that the content posted within the App is safe and appropriate.
• Reporting and Blocking Features:
  • Users can report objectionable posts (images, text, requests, etc.) by other users to the Operator using the in-app report button.
  • Users can block other users who engage in offensive behavior using the in-app blocking feature to hide content from the blocked user.
• Response Policy for Reports: Upon receiving a report of objectionable content, the Operator will promptly (as a guideline, within 24 hours) review the content and the user. If the Operator determines that the content violates these Terms or is otherwise inappropriate, the Operator will without delay remove (or hide) the content and restrict the user's access (including account suspension or termination).
• Operator's Administrative Rights: The Operator reserves the right to immediately delete or hide any post that the Operator determines violates these Terms or is contrary to public order and morals, with or without prior notice, regardless of whether a report has been received.

6. Exclusion of Anti-Social Forces

The user represents and warrants that they do not and will not in the future belong to any anti-social forces (organized crime groups, members of organized crime groups, related parties, or other similar entities).

7. Disclaimer

• Relationship with Apple: These Terms are concluded between the User and the Operator only. Apple Inc. ("Apple") is not a party to these Terms. Apple has no obligation or responsibility for maintenance, support, warranty, or any claims related to the App.
• Accuracy of Information: Information in the App is based on user posts, and the Operator does not guarantee its accuracy or usefulness.
• Limitation of Liability: The Operator shall not be held liable for any direct or indirect damage caused by the use of the App.

8. Changes and Termination

The Operator may change these Terms at any time as deemed necessary. The Operator may also suspend or terminate all or part of the service without prior notice.

9. Governing Law and Jurisdiction

The interpretation and application of these Terms shall be governed by the laws of Japan, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
